1. What Our Privacy Policy Covers?

The types of personal information we obtain about you depends on how you interact with us and our products and services.  When we use the term “personal information,” we are referring to information that identifies, relates to, describes, or can be associated with you.  The following are the categories and specific types of personal information that we collect:

Basic Identifying Information

Including your full name, alias, mailing address, billing address, e-mail address, phone number, payment information such as a credit card number, and other information that identifies you or that is about you and can be reasonably linked to you, or other similar identifiers.

Device Information and other Unique Identifiers

Including device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, or similar unique identifiers.

Certain information is automatically collected and analyzed whenever you interact with the Site.  This information may include the IP address used to connect your computer to the Internet, your domain name, country location, time zone, device and connection information such as browser type and version, operating system, entry and exit points/pages, and date/time of access.  

Our Site uses Google Analytics, which reports aggregate traffic to the Site so we can learn how the Site is being used, diagnose problems, and improve the Site.  Google Analytics also reports aggregate usage statistics for videos embedded on the Site through Google’s YouTube service.  When you interact with Google services through the Site, your information is collected and processed by Google in accordance with Google’s privacy policy, which can be found at https://policies.google.com/privacy.  You can also opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.

Internet or Other Network Activity

Including browsing or search history and information regarding your interactions with our Site, mobile application, emails, or advertisements.

Blackwood only collects sensitive personal information, as defined in the applicable U.S. state privacy laws, with your consent.  We do not use sensitive personal information for inferring characteristics about you.

4. How We Collect Your Personal Information?

Directly from You

We collect personal information you provide, such as when you make a purchase, participate in a campaign or promotion, sign up to receive emails, text messages, and/or postal mailings.

Using Online Tracking Technologies and Other Automatic Data Collection Technologies

When you visit our Site, open or click emails we send to you, or interact with our advertisements, we or third parties we work with automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.  For more information, please see the Cookies and Similar Online Tracking Technologies paragraph below.

Transactional Information

Details of transactions you carry out through our Site and for the fulfillment of your orders may require you to provide financial information before placing an order.

Automatic Data Collection Technologies (including Chatbots)

We may monitor and record communication between you and us that includes monitoring and recording of User’s session, keystroke logging while website is browsed, or use of website chat function.  User acknowledges and agrees that company may use a third-party service to automatically record and make transcripts of any communication between User and Company and share this information with third parties or service providers.  User acknowledges being a willing party to all communication with Company.  

User acknowledges and agrees that Company may utilize pixel tools to measure User interactions with Company’s website and share this information with advertisers and third-parties.  User understands that Company’s primary business is not in the distribution, sale, or renting of any video content.  Any video content displayed on Company’s website is strictly for limited advertising purposes.  There is no relationship between any account that you register with us or any subscription that you have with us and any video content.

We may obtain information from vendors that provide services on our behalf, or publicly available sources.  We also may create information based on our analysis of the information we have collected from you.

5. Cookies and Similar Online Tracking Technologies

We and our third-party partners and service providers (such as advertising and analytics providers) use pixels, web beacons, software developer kits, third-party libraries, cookies, and other similar online tracking technologies (collectively, “online tracking technologies”) to gather information when you interact with our Site and email communications.  Some online tracking technologies help us maintain the security of our Site, prevent crashes, fix bugs, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Site for analytics and advertising, including to help manage and display advertisements that tailor to your interests.  These third parties and service providers use their technology to provide advertising abut products and services tailored to your interests which may appear on our Site.

Our website has features such as, plugins, widgets, and/or other tools made available by social media platforms and networks that may result in information being collected or disclosed between us and such parties.  Their use of your information is not governed by this privacy policy.

Transfer of Control

We may disclose personal information to another company that buys some, or all, of the assets or stock of Blackwood, and that company may use and disclose personal information for purposes similar to what is described in this privacy policy.  Blackwood may also disclose personal information with prospective purchasers to evaluate the proposed transaction.

You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive from us.

10. Children’s Privacy

Our website is not intended for or directed to children under the age of 16.  No one under age 16 may provide any personal information to the Site.  If you are under 16, do not use or provide any information on this Site or through any of its features, register on the Site, make any purchases through the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use.  We do not knowingly collect personal information directly from children under the age of 16 without parental consent.  If we learn we have collected or received personal information from a child under 16, without verification of parental consent, we will delete that information.  If you believe we might have any information from or about a child under 16, please contact us at info@brandonblackwood.com.

Consistent with applicable law, you may exercise the rights described in this section.  Please note that some of the rights may vary depending on your country, province, or state of residence.  Under Virginia law, the definition of “sale” is the exchange of information for monetary consideration and does not include, for example, the transfer of personal information as an asset that is part of a merger, bankruptcy, or other similar transaction involving all or any portion of our business.  We and our advertising service providers use certain personal information to deliver online advertisements to you on your devices tailored to your interests, which could be considered “selling” under Colorado and Connecticut law.  State privacy laws’ definitions of “sale,” however, do not include the transfer of personal information as an asset that is part of a merger, bankruptcy, or other similar transaction involving all or any portion of the business.  

The Right to Opt Out of Cookies and Sale/Sharing Using Online Tracking Technologies
Our use of online tracking technologies may be considered a “sale” / “sharing” under applicable law.  Visitors to our website can opt out of being tracked by these third parties by clicking “Reject” in the Cookie Preferences, or by contacting us at info@brandonblackwood.com.

If you do not have an account with us or if you are not logged into your account, your request to opt out of “sale” / “sharing” will be linked to your browser identifier only and not linked to any account information because the connection between your browser and the account is not known to us.

The Right to Limit the Use of Sensitive Personal Information
California residents have the right to limit the use of sensitive personal information.  We only collect sensitive personal information, as defined by the applicable California law, for the purposes allowed by law or with your consent.  We do not collect or process sensitive personal information for inferring characteristics about you.

Some of the purposes for the collection and processing of sensitive personal information allowed by law include: to perform the services or provide the goods reasonably expected; to prevent, detect, and investigate security incidents; to resist malicious, deceptive fraudulent, or illegal actions directed at Blackwood and to prosecute those responsible for those actions; to ensure the physical safety of natural persons; for short-term, transient use; to perform services on behalf of Blackwood; and to verify or maintain the quality or safety of a product or service provided by Blackwood.

The Right to Access, Correct, and Delete Personal Information
You may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information.  You may also have the right to withdraw your consent to our processing of your personal information.  If you are a resident of California, Colorado, Connecticut, or Virginia you have the rights to access, correct, and delete personal information under the applicable law.  These rights may be limited in some circumstances by applicable law.

Please note that in many situations we must retain all, or a portion, of your personal information to comply with our legal obligations; resolve disputes; enforce our agreements; protect against fraudulent, deceptive, or illegal activity; or for another one of our business purposes.

If you have given us permission to store your credit card information and you don’t want merchants like us to receive your updated credit card information through your credit card issuer’s account updater service, please contact your card issuer.

You may submit a request for a copy of the information collected about you by following the steps outlined in the “Your Rights” section above.  California residents may do so for personal information collected in at least the last 12-months.  California and Colorado residents may do so up to twice per year per customer.

Responding to Requests
Once you have submitted your request, we will respond within the time frame permitted by the applicable law.  Please note that we may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

Appealing Requests
If you are a Colorado, Connecticut, or Virginia resident, you may appeal our decision to your request regarding your personal information.  To do so, please contact us in any of the ways listed in the “Communicating With Us” section.  We respond to all appeal requests as soon as we reasonably can, and no later than legally required.  

Identity Verification
For us to process some requests, we will need to verify your identity to confirm that the request came from you.  We may contact you by phone or e-mail to verify your request.  Depending on your request, we will ask for information such as your name, an e-mail address that you have used with us, or a phone number you have used with us.  For certain requests, we may also ask you to provide details about the most recent purchase you made online or in store.

Authorized Agent
Residents of California, Colorado, and Connecticut may designate an authorized agent to submit a request on your behalf to access or delete your personal information.  To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us.  Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.  If you have been designated as an authorized agent to submit a request on behalf of another customer, you must attach the appropriate authorization form when emailing info@brandonblackwood.com

Right to Opt-Out of Targeted Advertising (in Virginia, Colorado, and Connecticut)

We process and share some categories of personal information in connection with targeted advertising.  In Colorado and Connecticut, this processing may be considered a “sale.”  Consumers residing in Virginia, Colorado, Connecticut, and other states with similar privacy laws can opt out of targeted advertising and/or “sale” by:
